1. Agreement to These Terms
These Terms of Service (the "Terms") form a binding agreement between you and Via Nova Holdings LLC, a Wyoming limited liability company doing business as "My Point League" (an assumed name registered in Michigan) ("My Point League," "MPL," "we," "us," or "our") (together referred to as "the Parties" and individually sometimes referred to as a "Party"), governing your access to and use of the My Point League website at https://mypointleague.com and our web application (together, the "Service").
Please read these Terms carefully. By checking the box presented during account registration indicating that you agree to the Terms of Service and Privacy Policy, or by otherwise accessing or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not create an account or use the Service.
How you accept. Agreement is captured at the point of account creation through an un-checked checkbox that you must affirmatively select before an account is created; this requirement applies to both email/password registration and Google sign-in. We record your acceptance (user identifier, timestamp, and the version and effective date of the Terms and Privacy Policy you accepted). We may also ask you to re-confirm your agreement to the then-current Terms at the time of payment.
2. Who We Are
The Service is operated under the "My Point League" brand by Via Nova Holdings LLC. All contracts, banking, payments, and legal filings flow through Via Nova Holdings LLC. References to "My Point League" or "MPL" in these Terms mean Via Nova Holdings LLC doing business under that assumed name.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all registration information you provide is accurate and complete. The Service is not available to anyone previously suspended or removed by us.
4. The Service
My Point League is a web-based, season-long sports prediction game offered as a software service. Each participant picks one team per week from the relevant sports schedule; that team's game points are added to the participant's season total, and the participant with the highest cumulative total at the end of the season wins the league. A participant may generally use each team only once per season, subject to league settings. Rules, scoring, tiebreakers, and deadlines are presented on our Rules and FAQ pages, which form part of these Terms.
Private, organizer-run leagues. Competitions ("leagues") are private and run by an organizer (a "commissioner"). Participants join a specific league by invitation or invite link and, depending on the league's settings, may require commissioner approval. We do not operate public, open-to-the-world contests.
Sports and data. The National Football League (NFL) is supported for the 2026 season, with additional sports staged for future release as each season approaches. Schedule and score data is sourced from a third-party sports data feed (ESPN). Game results depend on that third-party data and on scheduled jobs running on time; postponed, cancelled, or corrected games are handled as described on our Rules page.
5. Accounts and Registration
To use the Service you must create an individual account. Authentication is provided through our backend platform; you may register with an email address and password (with email verification) or sign in with a Google account, in which case Google provides basic profile information (your name and email). You agree to provide accurate information, to keep it current, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at support@mypointleague.com of any unauthorized use. You may not share, sell, or transfer your account, and you may not create an account for anyone other than yourself.
6. User Roles and Responsibilities
The Service supports the following roles:
Commissioners (organizers) create and manage a league, set its rules and reminder preferences, invite and approve participants, may remove or ban participants, may pay to upgrade the league's player capacity, and may email their league members. Commissioners are the paying customers.
Players (participants) join a league, may set an optional screen name, make weekly picks, and view leaderboards and results. Players do not pay MPL to participate; the commissioner pays for the league.
Corporate / Partner prospects are visitors who submit the Corporate/Partner inquiry form to discuss a larger or branded arrangement. This is a sales lead, not an account.
Relationship between MPL, commissioners, and players. Each commissioner runs a private league and sets house rules within the framework the Service provides. Commissioners hold moderation power within their own leagues, including approving, removing, and banning participants. MPL provides the platform; MPL is not a party to, and is not responsible for, the conduct, decisions, house rules, or disputes of any commissioner or player within a league. Commissioners are responsible for their own conduct and communications and for administering their leagues in accordance with these Terms and applicable law.
7. Paid Tiers, Billing, and Refunds
Only commissioners pay, and only to increase a league's player capacity. Pricing is per league, per season, as a one-time charge with no auto-renewal.

Payment processing. Payments are processed by Stripe. We do not receive or store full card numbers. We store a record of each transaction (tier, amount, and status) to reflect your league's entitlement. Prices are stated in U.S. dollars and are exclusive of any applicable taxes. We may change prices and tiers prospectively.
One-time charges; no subscription. Charges are one-time; there is no recurring subscription to cancel and nothing auto-renews.
All sales are final. League-capacity upgrades are digital entitlements delivered immediately and are non-refundable. Except where a refund is required by applicable law, all sales are final and we do not provide refunds or credits for partially used seasons, unused capacity, or leagues that do not fill.
8. Nature of the Game; No Cash Prizes
My Point League sells software (league seats) and operates a season-long points game. As operated, MPL does not collect entry-fee money into a prize pool and does not pay out cash prizes; payments are for player-capacity upgrades only. The Service is positioned as software, not gambling or a game of chance. Any prize a commissioner or league chooses to award is arranged solely among the participants of that league; MPL neither operates, holds, nor pays any such prize and is not responsible for it.
No wagering. You agree not to use the Service for betting, wagering, or any pooled cash-prize arrangement operated through the Service. You are responsible for ensuring your participation is lawful where you live.
9. Acceptable Use
You agree not to, and not to attempt to:
Use the Service for any unlawful purpose or in violation of these Terms;
Impersonate any person or misrepresent your affiliation, or use a false identity;
Post or transmit content that is unlawful, harassing, abusive, defamatory, hateful, obscene, or infringing;
Cheat, manipulate scoring, use bots or automated means to make picks, or otherwise interfere with the integrity of the game;
Access another user's account, or collect or harvest other users' information without authorization;
Probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measure;
Introduce malware or interfere with, disrupt, or place undue load on the Service or its infrastructure;
Copy, scrape, reverse engineer, or create derivative works from the Service except as permitted by law; or
Use the Service to send spam or unauthorized commercial communications.
Commissioners must not use messaging features to send content that violates this Section, and must not admit or retain participants in violation of applicable law.
10. User Content
The Service allows limited user-generated content, including screen names and display names, commissioner-composed messages to their leagues, and Corporate inquiry messages ("User Content"). You retain ownership of your User Content. You grant MPL a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and transmit your User Content as necessary to operate and provide the Service. You represent that you have the rights to your User Content and that it does not violate these Terms or the rights of others. We may remove User Content that we believe violates these Terms.
11. Commissioner Messaging
A commissioner may send messages ("blasts") to the members of their league. These messages are operational communications related to a league you have joined, sent through the Service on the commissioner's behalf. Commissioners are responsible for the content of their messages and for using messaging features only for legitimate league-administration purposes and in compliance with applicable law. If you no longer wish to receive a particular league's communications, you may leave that league or adjust available preferences; transactional messages necessary to operate your account remain in effect.
12. Intellectual Property
The Service, including its software, design, text, graphics, and the "My Point League" name and brand, is owned by or licensed to Via Nova Holdings LLC and is protected by intellectual-property laws. A trademark application for the My Point League wordmark has been filed and is pending. Except for the limited right to use the Service under these Terms, no rights are granted to you.
Third-party marks; non-affiliation. The Service displays professional and collegiate team names and schedules and uses a third-party sports data feed. All third-party names, logos, and marks are the property of their respective owners. My Point League is not affiliated with, endorsed by, or sponsored by any sports league, team, or data provider, and no such affiliation or endorsement should be inferred.
13. Third-Party Services and Dependencies
The Service depends on third-party providers, including those that host the application, process payments, deliver email, provide authentication, and supply sports data. Your use of certain features may be subject to those providers' own terms. We are not responsible for the acts, omissions, availability, or content of third-party services, and their inclusion does not imply endorsement.
14. Service Availability; Disclaimer of Warranties
We provide the Service on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that game data (which depends on third-party feeds and scheduled jobs) will always be accurate or on time, or that defects will be corrected. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, in no event will Via Nova Holdings LLC or its members, officers, employees, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or the value of any league or standing, arising out of or relating to your use of (or inability to use) the Service, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to indemnify, defend, and hold harmless Via Nova Holdings LLC and its members, officers, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms or applicable law, or, for commissioners, your administration of a league and your communications with its members.
17. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service, or remove any league or User Content, at our discretion - including for violation of these Terms, suspected fraud or abuse, to protect the Service or other users, or as required by law. Because paid upgrades are one-time and non-refundable, termination for cause does not entitle you to a refund. Sections that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution - will survive.
18. Governing Law and Dispute Resolution
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Michigan without reference to principles of conflicts of law.
Confidential Pre-Litigation Mediation. As a condition precedent to the filing of a lawsuit by either Party, except when a Party seeks temporary or preliminary equitable relief or when delay will unduly prejudice a Party, the Parties agree to engage in a confidential and good faith mediation with a mediator to be chosen upon mutual agreement of the Parties. Unless mutually agreed to the contrary, the Parties will schedule the mediation to take place within fourteen (14) days of the date the dispute arises. In those instances where temporary or preliminary equitable relief is sought or delay will unduly prejudice a Party, the Parties will engage in the confidential mediation within thirty (30) days of the filing of the lawsuit. The Parties will comply with all confidentiality and other agreements reasonably required by the mediator. The Parties also agree to confer on the voluntary exchange of information, documents and other data that will assist the confidential mediation process. It is the express intent of the Parties that the mediation described in this Section supplant and supersede any other pre-litigation dispute resolution procedures, including those imposed by the court, by statute, or otherwise.
Forum and Venue. Subject to the above, the Parties agree that the forum, jurisdiction and venue for any dispute arising under this Agreement shall be brought in Livingston County, Michigan, or in the United States District Court for the Eastern District of Michigan, which shall be the exclusive forums therefor. The Parties hereto hereby irrevocably submit to the in personam jurisdiction and process of the courts in the State of Michigan.
19. Changes to These Terms
We may update these Terms from time to time. Each version carries a version number and effective date. If we make material changes, we will provide notice and, where appropriate, require you to review and re-accept the updated Terms before continuing to use the Service; we record each acceptance (user identifier, timestamp, and version/effective date). Your continued use after an update takes effect constitutes acceptance to the extent permitted by law.
20. General
Entire agreement. These Terms, together with the Privacy Policy and the Rules and FAQ pages, are the entire agreement between you and MPL regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, outages of third-party providers, network or infrastructure failures, and changes in third-party sports data or scheduling.
